GENERAL TERMS AND CONDITIONS
These General Terms and Conditions (“Terms”) govern the contractual relationship between Itaca Tours Ltd (“Itaca Tours”, “we”, “us”, or “the Company”) and the user (“you” or “the Client”) arising from:
- The use of the website www.itacatours.com (“the Website”)
- The consultancy and travel advisory services provided by Itaca Tours
- Any bookings facilitated directly by Itaca Tours or indirectly through affiliated partners, including the booking portal accessible at booking.itacatours.com
Purpose and Scope
These Terms establish the rights and obligations of both Itaca Tours and the Client in connection with travel related services. They apply to all services offered directly on www.itacatours.com, as well as to reservations managed through affiliated providers. For reservations made through booking.itacatours.com, the General Terms and Conditions of TOR Global Travel (CICMA nº 3750), S.L.U., apply in addition to these Terms.
Itaca Tours Ltd operates globally. While the Company is incorporated in England & Wales, certain services may involve suppliers or partners located in other jurisdictions, including the United States and the European Union
Contract Formation
A binding contractual relationship is established when the Client:
- Requests services from Itaca Tours via online forms, email, telephone, or any communication channel
- Accepts a proposal, quotation, or booking confirmation
- Makes a payment for any service offered by Itaca Tours
Acceptance may be expressed:
- In writing
- Electronically (e.g., email, online acceptance)
- Implicitly through payment
All bookings are subject to availability and confirmation by third‑party providers.
The Client is solely responsible for ensuring the accuracy of all information provided, including but not limited to:
- Names and passport details
- Travel dates
- Preferences
- Contact information
Errors or omissions may result in additional costs or service limitations for which Itaca Tours is not responsible.
Services Provided
Itaca Tours provides travel-related services, which may include but are not limited to:
- Personalized travel planning and itinerary design.
- Advisory on destinations, accommodations, and activities.
- Facilitation of bookings through affiliate programs or directly with providers.
- Assistance in coordinating flights, transport, tours, and related travel services.
- General travel guidance and customer support related to purchased services.
Important Clarification: The contractual relationship regarding the actual performance of travel services (flights, accommodations, activities, etc.) is always established directly between the Client and the relevant third-party provider. Itaca Tours does not itself own or operate airlines, hotels, transportation companies, or tour operators. Instead, Itaca Tours acts as an intermediary or consultant between the Client and third-party service providers, and cannot be held liable for the performance, quality, or delivery of services provided by third parties.
Service Fees and Commissions
Itaca Tours may charge service fees and/or receive commissions for advisory and travel planning services.
All fees will be disclosed to the Client in advance, before finalizing any booking. These may take the form of:
- A fixed consultancy fee.
- A percentage-based commission on the booking value.
The Client’s acceptance of a proposal, quotation, or booking confirmation shall constitute express acceptance of these fees or commissions.
Unless otherwise agreed in writing, service fees paid to Itaca Tours are non-refundable, even if the Client subsequently cancels or modifies the travel arrangements.
Payments and Charges
Payments must be made using methods accepted by Itaca Tours (e.g., credit/debit card, PayPal, bank transfer, or other expressly indicated methods).
All payments shall be made in the currency specified at the time of booking.
Depending on the method of payment, processing or booking surcharges may apply. These will always be disclosed before the Client finalizes the payment.
Reservations made through booking.itacatours.com are subject to the following surcharges:
1.90% for Visa, MasterCard, or Maestro.
2.55% for American Express.
In case of payment failure, delay, or reversal, Itaca Tours may cancel the reservation without liability.
Itaca Tours reserves the right to withhold booking confirmation until full payment has been received and verified.
Changes, Cancellations, and Refunds
The Client acknowledges that changes and cancellations are subject to the policies of the third-party providers (airline, hotel, tour operator, etc.) involved in the reservation. Itaca Tours will inform the Client of applicable policies prior to booking whenever possible. Refunds, if applicable, will be processed in accordance with the provider’s policies and may be subject to administrative fees charged by Itaca Tours.
Service fees or commissions paid to Itaca Tours for consultancy or advisory work are generally non-refundable.
Travel Documentation and Client Responsibilities
It is the sole responsibility of the Client to ensure that they hold valid travel documents, including passports, visas, vaccination certificates, and insurance policies, as required for the chosen destination. Itaca Tours may provide general guidance but cannot be held responsible for denied boarding, entry refusals, or penalties due to missing or incorrect documentation.
Limitation of Liability
Itaca Tours acts as an intermediary between the Client and third-party service providers. The Company shall not be held liable for:
- Failures, delays, or deficiencies attributable to third-party providers.
- Cancellations or changes imposed by airlines, hotels, or tour operators.
- Damages resulting from force majeure events such as wars, strikes, natural disasters, pandemics, or government restrictions.
In no case shall the liability of Itaca Tours exceed the amount paid directly by the Client to Itaca Tours for the relevant service.
Insurance and Risk Assumption
Itaca Tours strongly recommends that Clients purchase comprehensive travel insurance covering, at a minimum, medical expenses, trip cancellations, lost luggage, accidents, and any other risks inherent to travel. Clients are solely responsible for obtaining such insurance and ensuring that the coverage meets their personal needs and the requirements of the destination country.
By accepting these Terms, the Client acknowledges that travel inherently involves risks and agrees that Itaca Tours cannot be held liable for incidents, delays, losses, or damages beyond its reasonable control.
In accordance with UK regulations and professional standards, Itaca Tours maintains valid and active insurance coverage, including:
- A Professional Indemnity Insurance (Errors & Omissions) policy covering potential claims arising from consultancy, advisory, and booking-related services.
- A Public Liability Insurance policy covering bodily injury, property damage, and other liabilities that may arise in the normal course of business operations.
This insurance coverage is held to protect both Itaca Tours and its Clients, but it does not replace or substitute the need for Clients to obtain their own personal travel insurance.
Complaints and Claims
Clients may submit complaints regarding services provided by Itaca Tours by writing to legal@itacatours.com. Complaints will be acknowledged within 10 business days and resolved within the timeframes required by applicable law. For complaints regarding third-party providers, Itaca Tours will assist the Client in contacting the provider but cannot guarantee outcomes.
Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales.
For bookings made through booking.itacatours.com, Spanish and EU law may apply under the responsibility of TOR Global Travel S.L.U.
In case of disputes, Clients may bring claims before:
- The courts of England and Wales
- The courts of their country of residence
- Where applicable, the courts of Madrid (Spain)
Amendments
Itaca Tours reserves the right to amend these Terms at any time. Updates will be published on the Website with the indication of the ‘Last Updated’ date. Continued use of the Website or acceptance of services after updates shall constitute acceptance of the revised Terms.
Final Provisions
These Terms form part of the legal framework of Itaca Tours alongside the Privacy Policy and the Legal Notice. In the event of conflict between these documents, the specific provisions applicable to the service in question shall prevail. In case of discrepancies between translations, the English version shall prevail unless otherwise required by law.
